My specialties

Construction law

The construction and real estate sector is an anchor of stability and a driver of growth for the German economy. At the same time, it fulfills an essential function for society as a whole: it creates a liveable living and working environment. Construction and real estate law is characterized by a particularly high number of legal standards, whereby the boundary between legal and technical regulations is fluid. In addition, digital and sustainable solutions are also playing an increasingly important role here and are politically prescribed. In this complex environment, we provide you with comprehensive, targeted and specialized advice so that you are prepared for the legal challenges that arise in construction projects.

Building Smart

Building is technically complex. At the same time, it should be sustainable. The set deadline and budget targets should be met. At the moment, construction projects too often end in disputes over supplements or defects and none of the targets set are achieved. At the same time, the world is becoming more digital. A rethink is therefore necessary. Smart building is the order of the day and we provide the necessary legal tools.

Real Estate

We deal with all important issues relating to real estate and advise our clients in particular on real estate transactions, project developments and asset management. Our team is proficient in the development and management of large-scale real estate projects – from planning to execution and sales through to realization.

Planning & Project Management

Technically demanding projects require professional planning and implementation. Creating the optimum legal framework for such projects and being able to successfully accompany such projects requires a high degree of understanding of the given technical and economic contexts. We claim to understand something of what moves you in relation to your projects. That is why we are at your side in the best possible way.

Public procurement law

As specialist lawyers for public procurement law, we provide our clients with comprehensive support in all legal matters relating to tenders above and below the EU thresholds. We support the public sector and other clients in the design and implementation of procurement procedures. As lawyers for public procurement law, we also support companies that apply for public contracts as bidders and, if necessary, ensure effective legal protection – not only in review proceedings.

I carry out my professional work as a lawyer with great commitment, conscientiousness and attention to even the smallest detail.
The focus of my work is on construction and real estate law.
This is a varied and complex field that requires quick and practicable solutions and makes a close and open exchange with you as a client indispensable.

New directive on federal funding for efficient buildings (BEG) and effects on contract design

A presentation as part of the general meeting of the Baden-Württemberg Glass Window Facade Association.

The revised funding guidelines for BEG EM came into force on January 1, 2024. This entails considerable changes that also affect the exporting companies. In particular, it will be necessary in future for the developer to submit a contract subject to a condition precedent or condition subsequent when submitting the application. This includes issues relating to the provision of services before the funding decision is issued, contract and execution deadlines and price adjustments.”

Schwetzingen Administrative Law Days 2024 – Subsidy law

Subsidy law: Sabine Przerwok, specialist lawyer for public procurement law and specialist lawyer for construction and architectural law, will give a lecture on the current status of subsidy law on April 18, 2024. When it comes to the processing of subsidies already granted for projects by private and public clients by the EU, federal government and federal states, questions or even reclaims of subsidies paid out regularly arise.

New in April 2024: “Construction law for construction companies – a construction compass”

Practice-oriented and targeted

The book is based on the main responsibilities of a company’s departments in the realization of a construction project. Quotations and contract conclusion, purchasing, construction site coordination, service and maintenance are also covered in individual chapters, as is management. The practical structure means that every reader can find the relevant chapter at first glance.

Interesting facts for the trade

The year 2024 will bring numerous legal changes that are also of great importance for trade businesses. Our partner Dr. Alexander Hoff informed the members of the Guild for Sanitary and Heating Technology in-house on March 5, 2024 about numerous legal regulations and also gave an insight into the current case law of the Federal Labour Court. The presentation was followed by an interesting discussion.

Compliance

Companies, their executive bodies and employees have to know and observe a large number of sometimes complex rules. If violations occur, there is not only the threat of criminal and civil law consequences, but often also reputational damage and business losses. The scope of the rules, their complexity and the level of sanctions have been steadily increasing for years. At the same time, companies are losing money because they are not taking advantage of business opportunities due to excessive caution. With our many years of experience, we help you to identify and objectively assess risks without ignoring or over-dramatizing them.

Bartsch Rechtsanwälte at the EXPO Real in Munich

From October 4 to 6, the largest real estate trade fair EXPO Real took place again in Munich. Investors, project developers and construction companies from all over the world met to exchange experiences.

Our partner, the Karlsruhe TechnologyRegion, was also represented there with its own stand and we had many opportunities to talk to clients and interested parties and share our experience and knowledge.

This year in Munich, around 1,900 exhibitors from 36 countries presented their services to 40,000 participants with a focus on sustainability, digitalization and the transformation of the real estate industry.

Advoselect webinar, topic: Energy and heat

Energy security, energy supply and energy prices are not only an economic issue, but also present us with legal challenges.

The law firms in the Europe-wide Advoselect network of lawyers have therefore taken up this issue. In five short articles, you will learn interesting facts about rental and lease agreements for solar and wind power plants, about intra-European energy trading, but also about an important topic for local authorities and investors, namely the possibilities accelerated by politics to designate areas for wind power use.

Our partner Alexander Hoff spoke about this (in the video from minute 41). We look forward to receiving your suggestions.

Karlsruhe Expert Forum convenes

“It is not legal arguments, but technical know-how that decides the legal dispute” – this provocative thesis proves to be true in numerous construction lawsuits, which are often less about legal issues than about construction details and technically complex contexts. The work of court-appointed experts is therefore of particular importance in these proceedings. Our partner Alexander Hoff gave the opening lecture at this year’s annual conference and highlighted the particular challenges for the parties involved in the proceedings when it comes to dealing with technical issues in court proceedings.

A big thank you to the organizers, especially the Fachverband Glas Fenster Fassade Baden-Württemberg, for the professional preparation and implementation and a compliment to all the live and online listeners for the committed discussion and the first-class contributions.

Making city centers more attractive – but how?

The IHK Karlsruhe organized a symposium on this topic on 22.11.2022, at which our partner, lawyer Dr. Alexander Hoff, gave a lecture.

Dying retail trade, precarious housing situations, neglected building fabric and deficiencies in safety and order – many municipalities complain that their city centers are affected. What to do?

Alexander Hoff outlined the legal options available to stop the decline and make city centers more attractive. The audience was particularly interested in the possibility of improving the attractiveness of certain neighbourhoods through self-organized neighbourhood communities of owners and also taking advantage of government assistance.

A big thank you to the IHK’s real estate and location development working group for taking on this important topic of inner city design!

Real estate and city centers – IHK Karlsruhe event

What are the prospects for inner-city commercial units? Vacant retail spaces, falling visitor numbers in city centers and deserted town centers – the pandemic has greatly accelerated this transformation process.

The focus of my work is on supporting complex construction projects and Europe-wide procurement procedures. I advise (public) clients, investors, architects and engineers as well as companies on projects and, if necessary, also in court or before the public procurement tribunals. He has particular expertise in sustainable planning and construction, so-called green contracts. I also have many years of experience in awarding IT and construction contracts, particularly in the medical sector.

Professional contract drafting combined with a feel for possible developments makes exactly this possible: the risk of cost-intensive and time-consuming disputes can be significantly reduced through forward-looking advice.

Providing forward-looking advice is my strength, and I use this to my clients’ advantage. Because even in legal disputes, those who act with foresight and do not react reflexively have an advantage.

I studied law at the Universities of Freiburg and Uppsala (Sweden). After my legal clerkship in Baden-Baden with stations at an international law firm in Stuttgart in the area of public law / real estate law and at the German Embassy in Copenhagen, I joined Bartsch directly in 2012. I have been a partner in the firm since 2017.

I am a specialist lawyer for construction and architectural law as well as public procurement law and have successfully completed the specialist lawyer course for administrative law.
