New publication: AI Regulation in practice!

The AI Regulation, also known as the “AI Act,” creates the first uniform legal framework for artificial intelligence in Europe. Companies are now faced with the task of understanding and implementing the legally compliant use of AI systems.

In their newly published handbook “Die KI-Verordnung in der Praxis” (The AI Regulation in Practice), our colleagues Dr. habil. Christian Förster and Julia Straburzynski provide guidance and practical insights into the provisions of the AI Regulation.

The handbook clearly explains the AI Regulation for anyone who regularly deals with AI applications in their company and monitors their use or decides on their use, whether in a specialist department, IT, or management.

The first part covers the basics of the AI Regulation, describes the different AI systems, and introduces the players and their roles. The second part systematically explains, with practical examples, the obligations that providers, operators, or other players must fulfill depending on the AI system.

More than 20 diagrams make it easier to get started with particularly complex regulations.

The book answers practical questions such as:

🔹When is an AI system “high-risk”?

🔹Are there also obligations for “harmless” applications?

🔹How do powerful AI systems and data protection go together?

🔹How do I make my AI system “cyber secure”?

🔹What should I do if my AI system may have caused damage?

Congratulations to our colleagues on the new publication!

More about me

Even at a young age, I faced my opponents, even if only on the tennis court in pursuit of the yellow felt ball.

Today, I meet my opponents in the courtroom and stand up for my clients’ interests with ambition, diligence and skill. In order to win the last point here too, I rely not only on a strategic approach, but above all on close and trusting cooperation with my clients.

Career

I studied law at the Universities of Tübingen and Heidelberg. During my studies, I gained an insight into the employment law department of a major international law firm. I also worked as a research assistant in a medium-sized law firm in Karlsruhe.

I completed my legal clerkship in Karlsruhe and Ludwigshafen. I deepened the employment law focus of my legal training by completing an elective traineeship in the employment law department of a leading international chemical group.

Bartsch Rechtsanwälte at the EXPO Real in Munich

From October 4 to 6, the largest real estate trade fair EXPO Real took place again in Munich. Investors, project developers and construction companies from all over the world met to exchange experiences.

Our partner, the Karlsruhe TechnologyRegion, was also represented there with its own stand and we had many opportunities to talk to clients and interested parties and share our experience and knowledge.

This year in Munich, around 1,900 exhibitors from 36 countries presented their services to 40,000 participants with a focus on sustainability, digitalization and the transformation of the real estate industry.

Advoselect webinar, topic: Energy and heat

Energy security, energy supply and energy prices are not only an economic issue, but also present us with legal challenges.

The law firms in the Europe-wide Advoselect network of lawyers have therefore taken up this issue. In five short articles, you will learn interesting facts about rental and lease agreements for solar and wind power plants, about intra-European energy trading, but also about an important topic for local authorities and investors, namely the possibilities accelerated by politics to designate areas for wind power use.

Our partner Alexander Hoff spoke about this (in the video from minute 41). We look forward to receiving your suggestions.

My areas of expertise

IT Law

Information technology law (“IT law”) concerns the large area of software, hardware and data processing, which is developing and changing faster than almost any other area. It is therefore easy to lose track of things. We offer you sound advice and support you in all legal matters relating to your IT, including contract review and drafting, licenses, hosting and, last but not least, cybersecurity, to ensure that your IT business practices are legally sound and protected against harmful interference.

Data protection

We offer comprehensive legal advice in the area of data protection to ensure that your practices comply with applicable data protection laws. Our services include drafting customized data protection policies, monitoring and auditing data processing activities and ensuring full compliance with all relevant data protection regulations.

Industrial Property Rights

Intellectual property law is used whenever you need to protect your intellectual property, such as patents, trademarks and copyrights, and protect it from damage caused by unfair competition. We support you with tailor-made legal structuring (e.g. trademark searches and registrations, structuring and obtaining licenses and rights of use) as well as with the enforcement of or defence against claims for compensation in the event of infringement.

More about me

“Information technology and business are becoming inextricably interwoven. I don’t think anybody can talk meaningfully about one without the talking about the other.” – Bill Gates

It became clear years ago that technology and companies are inextricably linked. My aim is therefore to provide legal advice with a view to technological progress. As part of this, I advise my clients in all areas of IT law and contract drafting. In doing so, I combine my specialist legal knowledge with my understanding of IT to offer my clients modern legal advice in the fast-paced world of IT law. It is important to me to work on an equal footing in order to ensure that both sides have a clear understanding of the issues and that no questions are left unanswered.

Commercial Law

You will hardly experience a working day on which you are not confronted with questions of commercial law, regardless of whether these are your own terms and conditions of delivery or purchase, ongoing agreements with customers or project-specific contracts. With our many years of experience, we can help you with the rapid provision of standard contracts as well as with the drafting of complex special agreements. We can also check the rules and regulations of your business partners and assist you in contract negotiations.

Transportation & Logistics

Transport & Logistics includes the efficient planning, organization and implementation of goods and freight transport as well as the management of warehousing and distribution processes to ensure the smooth running of the supply chain. We support you from a legal perspective by reviewing, drafting and negotiating contracts for you, helping to identify liability risks and handling any claims.

More about me

In more than two decades of university work, I have learned to get to the bottom of a legal problem before presenting my findings. For one thing, the devil is in the detail, and for another, you can only explain convincingly what you have understood yourself.

I therefore first listen to my clients to find out what is bothering them and what their goal is. My main task is then to pave the legal way for them to get there. This in turn means analyzing the advantages and disadvantages of the various alternatives and explaining them to the client. We can then decide together which is actually the best solution.

Career

I studied law at the University of Tübingen [from 1992 to 1997].[von 1992 bis 1997] Impressed by the elective station in Tokyo at the end of my legal clerkship, I began studying Japanese Studies in Tübingen and Kyoto [in 1999] parallel to my dissertation project.[1999] I completed my doctorate [2002] on the topic of corporate law: “The Dimension of the Company: A Chapter in German and Japanese Legal History”. [2002]

I then remained at the University of Tübingen as a research assistant and completed my habilitation there with the thesis: “Die Fusion der Personalsicherheiten – Eine Neusystematisierung von Bürgschaft und Garantie aus rechtsvergleichender Perspektive” [2009].[2009] I received a teaching license for the subjects of civil law, commercial and business law and comparative law.

This was followed by temporary professorships in Bonn, Dresden, Frankfurt am Main and Freiburg. After a first brief foray into the legal profession, I was offered a professorship for “Transcultural Studies (Social Sciences)” at the Cluster of Excellence “Asia and Europe” at the University of Heidelberg [in 2014], which I held until the Cluster expired [at the end of 2018]. [Ende 2018] [2014]

I have been a partner at Bartsch Rechtsanwälte since January 2019.
